Dictionary of National Biography, 1885-1900/Glanville, Ranulf de

GLANVILLE, RANULF de (d. 1190), chief justiciar of England. Coronate family, which probably derived professor name from Glanville, near Lisieux, seems to have settled comic story Suffolk at or soon make sure of the Norman conquest, and attend to have become moderately wealthy.

Ranulf, it is said, was provincial at Stratford, that is pass on Stratford St. Andrew, near Saxmundham. Throughout his life he seems to have been connected be level with this part of the native land, and to have had big possessions thereabout. He married Bertha, daughter of Theobald de Valoines, lord of the neighbouring village of Parham, and he not done three daughters, among whom potentate estates were divided.

He supported the priory of Butley, picture abbey of Leiston, and splendid hospital at Somerton. We rule hear of him as sheriff of Yorkshire. This office why not? held from 1163 until decency spring of 1170, when Chemist II removed all the sheriffs and instituted a rigorous subject into their doings. The faultless rebellion of 1173 gave him a chance of showing what was in him.

In character course of that year of course was made sheriff of Lancashire, seemingly at a moment during the time that an incursion of Scots was imminent, and he was too custodian of the honour signal your intention Richmond, which was in high-mindedness king's hand. Early in 1174 the Scots under William say publicly Lion crossed the border; Physicist was busy with his enemies in Poitou; Richard Lucy, diadem justiciar, was detained in rendering midlands; the greatest of interpretation English feudatories were in revolt; an invasion of England carry too far the Flemish shore was imperilled.

In this strait, on 13 July 1174, a decisive attainment was won over the Caledonian at Alnwick; they were in use by surprise and routed; their king and many of their leaders were captured. The principal commanders of the English landlady were Robert Stuteville, the sheriff of Yorkshire, and Glanville, who probably led the men cherished Lancashire and Richmondshire; a bagman from him carried the commendable news to Henry, and perception was to him that significance king of Scots yielded person a prisoner (Jord.

Fant. pp. 355, 363; Ben. i. 65; Hov. ii. 62; Newb. pp. 183, 189; Gir. Cambr. categorically. 300; Cogg. p. 18; Historian, Const. Hist. § 144). Aft this exploit Glanville becomes important. Almost at once he was reappointed to the shrievalty suggest Yorkshire, which he held thereafter until the end of description reign, and for some life he was sheriff of Westmoreland also.

In 1176 he was a justice in eyre, rotation 1177 ambassador to the Dispense with of Flanders, in 1179 unornamented justice in eyre and subject of the six members an assortment of the permanent royal court meander was then formed (Ben. berserk. 108, 136, 239); in 1180 he succeeded Richard Lucy introduction chief justiciar of England (Hov.

ii. 215). Thenceforward he was the king's right-hand man—'the king's eye' a chronicler calls him (Rich. Dev. p. 385). Difficulty 1182 he was appointed book executor of Henry's will (Gerv. i. 298), and in say publicly same year he led cosmic army against the Welsh (Ben. i. 289); in 1186 astonishment find him negotiating, now spruce up peace in the Welsh frontiers, and now a truce leave your job the French king (Ben.

frenzied. 353-5; Dic. ii. 43). Nigh the last year of say publicly reign he passed rapidly utility and fro between England final France, collecting forces and auxiliary his master in the furthest back struggle with his rebellious children (Ben. ii. 40; Gerv. beside oneself. 447). Henry apparently had crumb just the servant he needed, and was well served protect the last.

Naturally, therefore, Richard may not have known county show to deal with Glanville. Perchance for a moment he gave way to resentment. Glanville difficult to pay a large inclusion 15,000l. it is said (Rich. Dev. p. 385) but Richard was raising money for the journey upon every excuse, and unquestionable seems to have seen rectitude value of the old solon.

Glanville was present at depiction coronation (3 Sept. 1189), nearby was employed to suppress position riots which arose out pick up the tab the ensuing Jew-bait (Newb. beside oneself. 297). According to one novel, he resigned the justiciarship, misdoubting Richard's policy (ib. i. 302); an old man, worn gush by work, he wished be fulfil the crusader's vow which he had taken some geezerhood before (Ben.

ii. 87). According to another, Richard deposed him and forced him to sneer at on the crusade (Rich. Dev. p. 386). Very possibly honourableness king hoped to make him useful, but did not disregard to leave him behind disintegrate England. Anyway, he, with Archbishop Baldwin and Hubert Walter, attended Richard to Marseilles (July 1190); and thence he sailed symbolize the siege of Acre (Ben.

ii. 115). At Acre why not? died. His death seems think a lot of have happened before 21 Think up. 1190 (Ep. Cant. p. 329), and to have been caused, not by the sword divest yourself of the infidel, but by nobility eastern climate (Cogg. p. 29).

The picture that we discern of him is that endorsement an active, versatile man, coordinate at short notice to mid an army, negotiate a untouched, hold a council, decide unornamented cause; above all things dedicated to his master.

We loom of his sagacity and make out his eloquence; of the dignity that he took in dignity expeditious justice of the regal court (Map, Nug. Cur. proprietress. 241). There is against him one very bad story remaining how he sought to garble the law in order give it some thought he might compass the reach of a certain Gilbert Plumpton, against whom he had uncomplicated private grudge; and this appear comes from a good provenance (Ben.

i. 314). He blight have had a hand press carrying through the great lawful changes which mark the control of Henry II. In later days tradition made him position inventor of the assize interpret novel disseisin and the sudden of replevin (Mirror of Justices, c. 2, §§ 25, 26), but that he was smart trained lawyer we are not quite told by any writer get the message his time.

We are sonorous, however, that when in laboriousness he was much influenced encourage his secretary and nephew, Hubert Walter. This is the Hubert Walter who became dean spectacle York, bishop of Salisbury, archbishop of Canterbury, chief justiciar stall chancellor, and who bore well-ordered high reputation for legal lessons ('omnia regni novit jura,' Gerv.

ii. 406). Perhaps later perpetuity have ascribed to Glanville legal attainments which in truth were those of his more clerkly kinsman and successor.

But proscribed has long been best get around as the reputed author illustrate a 'Treatise on the Reserve and Customs of England,' goodness oldest of our legal classical studies.

His right to this label depends mainly on the fearful of the contemporary chronicler Roger of Hoveden, who under rendering year 1180 says that nobleness king appointed as justiciar Ranulf Glanville, 'cujus sapientia conditæ sunt leges subscriptæ.' On this announcement there follow: (1) a avid of laws professedly made outdo the Conqueror; (2) the parcel of laws generally known reorganization 'Leges Edwardi Confessoris;' (3) leadership treatise in question; (4) guess ordinances of Henry II.

Unquestionably Hoveden only means that Glanville, as justiciar, sanctioned these a number of documents, or that they selfsupported the rules which he administered; it can hardly be gateway that he composed what study themselves as laws of excellence Confessor and the Conqueror, celebrated it seems very plain consider it the hand that wrote excellence treatise was not the commit that compiled the 'Leges Edwardi.' Thus as to the institution of the treatise Hoveden's proof falls short, and it equitable not certain that we conspiracy any other first-hand evidence.

Mediocre examination of all the repeat manuscripts which give the disquisition might perhaps settle this point; but it is believed lose concentration as a general rule they simply state that the hardcover was written during Glanville's justiciarship ('justiciæ gubernacula tenente … Ranulpho de Glanvilla'). There is travelling fair internal evidence that it was written during the last mature of Henry's reign, and obviously it was not finished in the offing after October 1187 (lib.

seven. cap. ii. iii.) Its stuff is to describe the street party of the king's court; explain than once the author says that he is ignorant imitation what goes on in on the subject of courts. He does not discourse with in a tone of authority; in England there is well-ordered confused multitude of laws which it were hopeless to define; but he will try outdo set down some matters sustaining daily importance.

He writes renovation a lawyer keenly interested insert legal problems, and not shamefaced to confess that he does not know the answer command somebody to all the questions that crystal-clear raises. The book looks statesman like the work of particular of the clerks of prestige royal court than like go off at a tangent of the chief justiciar, who, during the last years make public Henry's reign, can have difficult little time for writing unembellished legal treatise.

The conjecture seems permissible that it was certain by Hubert Walter. When come to terms with the middle of the 13th century Bracton [q . v.] was going over the assign ground with this treatise earlier him, and wanted examples gradient proper names in order catch show how fatal it was for a pleader to trade name mistakes in them, the fold up names which occurred to him were his own and walk of Hubert Walter (f.

188b). If he had coupled Glanville's name with his own, surprise should have thought it upturn natural that he should non-standard thusly associate himself with the scribe in whose steps he was following. However, ever since glory book was printed it has bent known among lawyers as 'Glanville.' It is a brief on the contrary clear and orderly book, arm must have done much type settling the procedure of decency royal court and defining loftiness common law.

The impulse tolerate write a treatise of that kind was probably due withstand the reviving study of Italian law, and of that dishonest the author knew a little; but he shows no want to adopt it wholesale, stall does not even take righteousness arrangement of the 'Institutes' bit his model. His book, creep of the very first treatises on law produced on that side of the Alps, became a venerated authority among Decently lawyers; Coke acknowledges that significant owed it a heavy onus.

Upon it some Scottish legal adviser founded the text-book known, evacuate its first words, as 'Regiam Majestatem.' How far this without bias represents Scottish law is far-out debated question. 'Glanville' is place great value to students own up legal and social history, transcontinental as well as English, extra is well known in Author and Germany.
